MANYUCHI IMPREGNATES MARRIED WOMAN

Former World boxing champion and holder of three welterweight titles, Charles Manyuchi bedded and impregnated a young married woman he trained at his gym resulting in a High Court order for him to pay US$18 000 in damages.

Justice Zisengwe, sitting at the High Court in Masvingo granted the damages in a default judgement made in favour of Tapiwa Munyaka last Tuesday.

Munyaka, a regional manager with a micro finance bank in Masvingo discovered the adulterous affair when he went through his wife’s Chengeto Viola Munyaka nee Dimingo’s phone in 2021. He bumped into pictures and images of the sexual escapades of the two.

Munyaka said he lost his self-esteem because of the relationship and was also exposed to sexually transmitted diseases including HIV because his wife and Manyuchi did not use condoms.

The stinging boxer’s gym operated from Flamboyant, a Regency Group hotel in Masvingo and Munyaka’s seven-year-old marriage has since broken down irrevocably, according to court documents.

Ironically, Munyaka was supportive of his wife’s involvement at the gym to the extent of even taking her there. He even allowed Viola to become one of the advertising persons for Manyuchi’s forthcoming boxing matches and she, together with a team of Manyuchi supporters would visit various holiday resorts including Kariba to celebrate the boxer’s victory.

“The defendant’s reckless conduct exposed me to the HIV virus and other sexually transmitted diseases. The fact that he impregnated my wife is clear evidence that he was not having safe sex with my wife. The pregnancy exposed me to the danger of looking after children sired by third parties… My self-esteem is now low. I am seriously hurt by defendant’s conduct,” reads part of Munyaka’s application.

Manyuchi is the former World Boxing Federation (WBF), Global Boxing Union, World Boxing Council (WBC) Silver welterweight and World Alliance Boxing Association (WABA) champion.

The adultery damages are the highest ever given by the High Court in Masvingo.

Manyuchi received a letter of demand in November 2022 but did not respond which led to an application for the default judgment.

Munyaka said Chengeto fell pregnant with Manyuchi and had an abortion. Munyaka paid lobola for Chengeto in 2015 and they solemnized their marriage in 2019. They have two children together.

He said Manyuchi recorded his sexual escapades with Chengeto and the affair was known by his workmates and this affected his reputation and self-esteem.

Munyaka sought US$50 000 damages; US$30 000 for consortium (the impact an injury has on the relationship, companionship and support lost) and US$20 000 for contumelia (insulting language of treatment). However, the Judge awarded Munyaka US$8 000 for consortium and US$10 000 for contumelia.

Munyaka said what hurt him most is that he went to Manyuchi’s training group together with his wife. That is where the former world champion took advantage and bedded his wife.

The affair allegedly began when the couple joined Manyuchi’s training group in 2021. Munyaka said Manyuchi selected Chengeto to participate in advertisements and promotions for his match against Ugandan Mohamed Sebyala.

Munyaka is represented by Charles Ndlovu of Ndlovu and Hwacha Legal Practitioners.

“In September 2021 he also invited my wife to join his team which was going to Kariba where he was going to celebrate his victorious match… He also invited her to various holiday spots claiming that she was good at promoting his sponsors’ products. I didn’t complain because I thought my wife was good at advertising the sponsors’ products,” said Munyaka.

He only knew of the affair towards the end of 2021.

Munyaka wrote a letter of demand to Manyuchi in 2022 and Manyuchi didn’t respond or make any efforts to apologise suggesting that he is not concerned with the outcome of the matter.

Munyaka then applied for a default judgment last month after Manyuchi did not respond to the two year claim. Masvingo Mirror


KIKKY ORDERED TO PAY US$18K

Hip hop artist and video vixen Christabel Stembeni Kikky badass’ Mahlungwa received the kick of a horse on Wednesday.

High Court Judge in Masvingo, Justice Sunsley Zisengwe has ordered her to pay top Masvingo lawyer, Rodney Saratoga Makausi US$18 000 in defamation charges. The lawsuit resulted from a March 2023 post on her Instagram in which she accused Makausi of soliciting for sex from her.

Makausi who is also a businessman sued her for US$500 000 after she refused to pull down the post she made to her 235 000 followers.

Kikky badass didn’t file her Pre Trial Conference (PTC) issues as directed by Justice Garainesu Mawadze and she didn’t attend the PTC on October 1, 2024, nor did she file her submissions leading Makausi to apply for a default judgment.

Makausi amended the amount to US$60 000 and was granted US$18 000 damages.

He told the court that Kikky didn’t make any attempts to retract the post after they engaged her and his standing and reputation as a lawyer, devout Seventh Day Adventist member, family man and community member was negatively affected.

Kikky earlier filed a plea for the case to be thrown out arguing that Makausi cannot demand civil damages in US$ as it is not the official currency. The plea was thrown out by Justice Zisengwe.

“As a devout Christian, professional man, respected legal practitioner and officer of the court, in a fairly small city like Masvingo, my reputation and character are my currency. The respondent’s defamatory posts have however caused irreparable harm to that fama. The embarrassment and ridicule that I have suffered as a result of her defamatory post is borne for no reason at all.

“While it is not mathematically possible to fully compensate for the injury, I verily believe that an award of damages in the sum of US$60 000 would serve in some way to ameliorate the injury to my reputation,” said Makausi.

EX ZIFA VP GRANTED BAIL IN O-LEVEL FORGERY CASE


Former Zifa vice-president, Gift Banda (54), was granted US$500 bail yesterday in his case of allegedly forging an O-level certificate.

As part of his bail conditions, Western Commonage regional magistrate, Sibongile Msipa-Marondedze, ordered him not to interfere with witnesses or investigations, and to reside at his given address. She adjourned the case to January 3 next year.

Despite the charge against him, Banda appeared in court in a cheerful mood, wearing designer clothes. However, the magistrate briefly halted proceedings to question why Banda was in leg irons as he had willingly presented himself to the authorities.

“Why is he in leg irons? Do you have a key? Remove those,” she instructed the prison guards.

Banda, who has previously served as Bulawayo deputy mayor and is known for his collection of luxury super cars, pleaded not guilty through his legal representative, Everson Chatambudza of Rubaya and Chatambudza.

Chatambudza argued that there were no compelling reasons to deny Banda bail, pointing out his “responsible” actions upon hearing the police’s interest in interviewing him regarding the allegations.

“He learned through social media platforms that the police were keen on interviewing him on allegations of forgery. As a responsible citizen, he went to the police and handed himself over,” Chatambudza stated.

He stressed that Banda is a family man with nine children, most under 18, and said there would be no reason for him to abscond given his significant assets and family responsibilities.

Chatambudza further contended that the charge against Banda lacks merit, suggesting that the situation might be more accurately described as fraud rather than forgery. He pointed out that the alleged forged document had been found in possession of the headmistress of Banda’s former school, raising questions about the validity of the accusations.

“This story does not hold any water. Why would someone go to their former school to tender a result slip,” he questioned, implying that the charges could be fabricated.

The defence attorney also noted that the document in question only bore Banda’s name and lacked an identification number, which could lead to confusion with others who share the same name.

“There could be numerous other people with that same name who could be owners of the document,” he asserted.

Despite the serious nature of the allegations, Banda’s legal team is optimistic about the case’s outcome, believing that the evidence against him is flimsy at best.

The case has attracted considerable attention, especially as Banda is reportedly eyeing a top position in Zifa executive committee.

According to the State, as represented by Milton Moyo, sometime in October this year, Banda allegedly forged an O-level examination slip, claiming he wrote the examinations in November 1986 using centre number 24236, candidate number 298.

However, the original examination sheet from 1986 shows that these details belong to one Sino Gumbo.

“Allegations are that on an unknown date but in October 2024, Banda phoned Sihle Sibanda, who is the Mpopoma High School’s acting headmistress, claiming he obtained his results from the Zimbabwe School Examination Council (ZIMSEC) since he lost his results slip.

“On an unknown date in November 2024, Banda personally went to Mpopoma High School and asked Sibanda for the confirmation of his 1986 O-level results. The results slip was not found in the school records. After about two weeks, Banda indicated to Sibanda that he had recovered his missing results slip from his archives. Verification was done, and it was established that the results slip was forged, and the confirmation indicated that the candidate number belongs to Sino Gumbo,” said Moyo. Chronicle

SUGAR TAX : GOVT TO BUY CANCER MACHINES

The Procurement Regulatory Authority of Zimbabwe (PRAZ) has given the greenlight to fast-track the procurement of new cancer machines, potentially before year-end.

The procurement of the machines is premised on the expected release of funds from the sugar tax towards beefing up the country’s cancer equipment.

Since the announcement of the sugar tax in the 2024 National Budget, the Government has raised more than US$18 million.

Speaking at this week’s post-Cabinet briefing, Health and Child Care Minister Dr Douglas Mombeshora said while awaiting the release of funds by the Treasury, his ministry had conducted the requisite research on the health sector needs.

“Now that we know that we are going to get money from the sugar tax, we have already sought some advice from the specialists who are the radio-oncologists to say what are their priorities in terms of the equipment that we require,” he said.

“We are at an advanced stage. Praz has approved our request to do a short bid, which is for five days, so that we shorten the procurement period, with a few conditions.

“So we are now in the process of actually requesting for those bids. We hope we will be able to do the procurement process within this side of the year, before December 31.”

Zimbabwe has two cancer treatment centres at Parirenyatwa Group of Hospitals in Harare and Mpilo Hospital in

 Bulawayo. However, the operation of the cancer machines in the two facilities has been erratic due to breakdowns. The Government has since repaired the machines at Parirenyatwa and Mpilo to restore services.

Dr Mombeshora said besides the repair of the existing machines, the plan was to add more machines at Parirenyatwa and Mpilo hospitals while procuring more machines to start new cancer treatment centres.

“We have got two cancer treatment centres in Zimbabwe, one at Parirenyatwa and the other one at Mpilo. “The one at Parirenyatwa is fully operational at the moment, the one at Mpilo now is operational but only the CT scan is not yet operational and we require some money to buy the spares for that CT scan. “We also plan to put other cancer treatment centres at Chinhoyi Hospital, Gweru Provincial Hospital, in Masvingo and Mutare.

The new centres will be fully operational with all the required equipment,” he said.

Meanwhile, the Ministry of Health has also made progress in implementing other projects aimed at improving healthcare service delivery for all.

Addressing the post-Cabinet meeting, Information Publicity and Broadcasting Services Minister Dr Jenfan Muswere reported that the construction of a National Tuberculosis Reference Laboratory at Mpilo Hospital was on course, with the construction of the superstructure being at 85 percent completion.

He also highlighted other projects that were being implemented under the 100-day cycle programme.“The construction of the water tank at Chitungwiza Central Hospital is on course, with the overall progress being at 55 percent of completion.

The installation of X-ray Machines at Chikurubi Maximum Prison Hospital and Inkomo Barracks Hospital was completed, while other hospitals are at various stages of completion,” he said.

Other projects include the construction of oxygen plant rooms at Lupane Hospital and Chinhoyi Provincial Hospital which are expected to be completed this month as well as the procurement of materials for the renovation of 10 waiting mothers’ shelters and theatres at Mt Darwin, St Albert’s, Siakobvu, Chidamwoyo, Sanyati, Father O’Hea, Manama, St Anne’s Brunapeg, Inyathi and Nkayi hospitals. HRE COUNCILLORS GRAB STANDS IN LEAFY SUBURBS

 Harare city councillors are facing corruption allegations after reportedly allocating themselves residential stands in leafy suburbs, contrary to Government policy.

The move follows the recent death of Mr Fani Machipisa, the head of human shelter services, who had been accused of resisting councillors’ corrupt demands.

The Ministry of Local Government and Public Works allows councillors to be allocated residential stands only within the wards they represent.

If no space is available in their wards, they can be allocated stands in neighbouring wards.

However, evidence suggests that many councillors have received stands in areas such as Borrowdale, Highlands, Greendale and Mt Pleasant.

Sources within council said there was infighting among councillors, amid claims that only a select group aligned with Mayor Councillor Jacob Mafume, was receiving preferential treatment in the allocation of the coveted stands.

Most suburbs in northern Harare were developed by private investors and landowners, so there would be very little land available to the city council under municipal ownership.

Even then, such properties would involve change of land use, and so there would be hardly any stands that could be created to be assigned to councillors.

“It is dog-eat-dog as only a cabal aligned to mayor Mafume is the one that is being given first preference to the affluent suburbs of Harare. Others are being sidelined”, said a source.

Housing committee chairperson and Ward 2 Councillor Blessing Muroiwa dismissed the allegations.

“Our parent Ministry’s circular is very clear on that matter. It states that each councillor shall be allocated a residential stand in his or her ward and that’s what we are following,” said Clr Muroiwa.

“To my records, no councillor has been allocated a stand outside his ward including myself. I am waiting until I get a vacant stand in Ward 2”.

However, the situation is not new. In 2022, CCC councillors were implicated in a land scam where they were buying commercial and industrial stands for as little as US$60 and reselling them at inflated prices.

The scandal involved several councillors and top council officials, raising concerns about systemic corruption within the local authority.

A Commission of Inquiry into Harare City Council’s affairs since 2017, has been investigating these land scams, and so far the probe has revealed that councillors illegally invaded and allocated over 5 000 plots ahead of elections in 2023.

The inquiry noted a pattern of land grabs by opposition councillors during election years to attract voters.

With ongoing investigations and a history of corruption, the allocation of residential stands by Harare councillors remains a contentious issue, highlighting the need for greater transparency and accountability within the city’s governance. Herald

A storm of scandalous proportions has erupted, apparently shaking the very foundations of faith and trust when a heartbroken man from Plumtree, Matabeleland South Province, made an impassioned plea to Prophet Shepherd Bushiri, founder of the Enlightened Christian Gathering (ECG) church, to take disciplinary action against his wife, and her alleged lover, Alfos Bukosibethu Nyathi.

The man, who prefers to be identified only by his surname Chiwawa, alleges that Kagande, a senior church leader, has been engaged in an extramarital affair with his wife since 2022, causing irreparable harm to their marriage.

He said he had been living with his wife since 2010 and formally married her in 2022. Chiwawa claims the affair began shortly after their wedding in 2022. He discovered the infidelity while preparing immigration documents for Kagande to join him in the UK.

Despite her confession to their church pastor only identified as Samuriwo based in Plumtree, Chiwawa says the church took no action, leaving him feeling betrayed and unsupported.

MUTSVANGWA'S SON OFF THE HOOK

Businessman Neville Mutsvangwa is now off the hook following the granting of his application for refusal of further remand.

Mutsvangwa and his suspected accomplices – Ellis Majachani and Simbarashe Tichingana – who were facing money laundering and illegal dealing in foreign currency cases, filed an application for refusal of further remand before magistrate Apollonia Marutya on Wednesday.

Through their lawyer Oliver Marwa, the trio argued that the continuous postponement of their case was unjustified as the State had failed to provide them with a speedy trial.

Two months ago, the State furnished the trio with a trial date but later made a U-turn saying it now wanted the trio to be tried at the High Court.

Magistrate Marutya ruled that the delay in the case  was unreasonable and ordered the State to proceed by way of summons when its house is in order.

The State was alleging that during the period extending from January 1 2019 to May 8 this year, the trio formed Mumba Money Transfer services without a licence in violation of the Bank Use Promotion and Suppression of Money Laundering Act and Exchange Control Act.

They advertised on the internet directing clients to their offices in Harare.

The trio allegedly employed a combination of electronic funds transfers and physical cash for their unlawful transactions, leveraging foreign bank accounts to obfuscate their activities.

The Police recovered four smartphones, 45 sim cards, four computers, one Point Of Sale (POS) machine, 28 debit cards (including 15 VISA cards issued by foreign banks), three money counters and a register of transactions and US$3 890 cash. H Metro

BROTHERS KILL BROTHER IN FIGHT

Tragedy struck a Chikanga family on Wednesday morning when a brutal fight among three brothers left one of them dead.

What began as an attempt by the siblings to ‘discipline’ their 36-year-old sibling, Prince, turned into a gruesome murder.

Two Dzotsera siblings — Emmanuel (32) and Peter (40) — are now up for the murder of their brother, Prince.

Acting Manicaland provincial police spokesperson, Assistant Inspector Wiseman Chinyoka, confirmed the incident, revealing that Prince Dzotsera was fatally assaulted by his brothers, Emmanuel and Peter.

“The fight started around 3am and continued until dawn, culminating in Prince’s death. The complainant, who is a tenant at the Dzotsera home, Mr David Muenzani tried to stop the three from fighting, but failed. He advised the three to solve their issues as a family. He left the room where they were fighting and went back to his lodgings. The fighting brothers went quiet for a while, and around 5am, the mother of the three siblings woke up Mr Muenzani, and told him that Prince had died,” he said.

When The Manica Post visited the scene hours after the tragic incident on Wednesday morning, an eerie silence blanketed the modest Chikanga neighbourhood.

Several people were milling around the crime scene, just after the police had ferried Prince’s corpse to the mortuary.

Onlookers in hushed voices and with solemn faces inspected the broken household furniture that include a television set, glass, a pushing tray and a decoder inside the Dzosera house.

Neighbours who witnessed the lead-up to the tragedy recounted a night filled with violent outbursts and cries for help.

According to witnesses, the brothers accused Prince of disrespecting their mother, an issue they claimed had persisted for months.

A tenant at the house, Mr Muenzani, shared in an interview a chilling account of what had happened.

“We were sleeping in our room when we were awakened around 3am by the quarrelling brothers as well as noise from the household goods that were being thrown around. I heard Emmanuel and Peter yelling at Prince, accusing him of abusing their mother, and I decided to intervene,” said Mr Muenzani.

But his attempt to mediate was met with hostility.

“The two brothers told me to leave them alone, saying it was a family matter. They said they had a right to discipline their errant brother. I tried to knock some sense in their heads, but they would not listen, so I went back to my room. Their mother even tried to intervene, but Peter told her that they were protecting her as she used to call him while at work in Bulawayo, telling him that Prince was assaulting her. Her mother left the brothers alone and went to her room. The noise stopped for a while, and I thought they had stopped fighting,” he said.

Mr Muenzani said the brothers resumed their quarrelling around 5am.

“Around 5am, they started again. My wife begged me not to go out this time. She said it was too dangerous. We thought they would eventually resolve their issues. Shortly afterwards, their mother came to our window, crying and knocking, telling us that Prince had died,” he said.

When Mr Muenzani rushed outside, he found the grim aftermath of the night’s conflict.

“There were already many people gathered, and Prince’s body was lying on the ground covered with a blanket,” he narrated.

Mr Muenzani said he was the only tenant who tried to help stop the fight even though eight families stay at the Dzotsera home. Manica Post

43 FOR HRE FINANCE DIRECTOR POST

Forty-three candidates are vying for the position of finance director at Harare City Council, a role that has been occupied on an acting basis since 2015.

The current acting director, Mr Godfrey Kusangaya, recently had his contract renewed for another year, despite facing allegations of bribery related to the contract’s approval by councillors.

The last substantive finance director, Mr Stanley Kwenda, was suspended in 2015 and spent years embroiled in disputes with the council before negotiating his exit package last year.

At yesterday’s full council meeting, Harare Mayor Councillor Jacob Mafume expressed astonishment at the high number of applicants for the finance director position.

“Forty-three people have applied for the finance director position; we are humbled with the response,” he said.

Despite the ongoing speculation, Clr Mafume clarified that Mr Kusangaya has no intention of pursuing the permanent role.

“Kusangaya has expressed no interest in the finance director position.  He will be a very generous man to bribe people to a position which he did not apply for,” he said, querying the unusual nature of the allegations.

The selection process for the candidates will be managed by the Local Government Board, which will shortlist applicants. Herald
