A Gweru City Council commissioner has appeared before the courts on allegations of assaulting a resident following a misunderstanding over allowances paid to thecommissioners and implementation of a government audit report.
Commissioner in charge of finance, Mark Choga allegedly assaulted Frank Muzorera all over the body resulting in the latter sustaining injuries on the neck and shoulder.
Choga appeared before magistrate Florence Nago on Tuesday for assault but denied the charges and instead alleged it was in fact Muzorera who insulted him.
State witnesses however maintained that Choga assaulted Muzorera before he was restrained from further assaulting him by residents and municipal police.
During trial, Choga’s defence witnesses said they saw Choga down after being assaulted by Muzorera.
They however gave conflicting accounts on whattranspired on the day in question.
The court heard that on February 18 this year, Muzorera and Choga were both part of a meeting between residents and commissioners at the mayor's parlour.
"During the course of the meeting, the complainant asked the accused person how much they (commissioners) earn as their allowances and why they were not implementing the outcome of the audit report," according to state papers.
"The accused person refused to answer the questions posed by the complainant and a misunderstanding arose and the accused proceeded to where the complainant was and hit him from behind once on the shoulder and neck."
The court further heard that Muzorera fell down and Choga kicked him all over the body with booted feet.
Residents and municipal police however restrained Choga from further assaulting Muzorera. Areport was made to the police leading to Choga's arrest.
The presiding magistrate said she expected to deliver judgment on August 29. Radio vop
